These terms are an agreement between you and KendTech SOLUTIONS of Port Moresby. They cover browsing this website, submitting an enquiry, posting a comment in the discussion under a page, buying a digital product, and holding a dashboard account. Where a signed quotation, contract or non-disclosure agreement covers a project, that document governs the project and these terms govern the website — and if they ever conflict on website use, these terms prevail; if they conflict on a piece of work, the signed document prevails.
✦What you are agreeing to, briefly
- Browsing is free and needs no account
You may read everything public without telling us who you are.
- What we publish is ours
Our text, layout, logo and case material must not be republished or scraped without asking.
- A download licence, not a sale of ownership
Buying a product in the Digital Marketplace permits use — not resale, redistribution or publishing it as your own.
- Nothing on this page is a binding offer
A price becomes binding only in a written KendTech quotation.
- Be honest and stay within the law
No fake identities, no malicious uploads, no using our forms or assistant to harm or mislead.
01Are these terms binding on you
Yes, from the moment you use this website. If you do not agree, the honest answer is to stop using the site and email us instead so we can help you another way. If you use the site on behalf of a company — which is most of our visitors — you confirm that you are authorised to bind that company.
These terms apply to visitors, buyers and dashboard users alike. Extra clauses apply once you hold a dashboard account (clause 5) or buy from the Digital Marketplace (clauses 7 to 10).
02Who we are, and what this website is for
KendTech SOLUTIONS is a technology services company founded in 2022, working from the University of Papua New Guinea Main Campus, Port Moresby. We design and build websites, business software, networks, cloud and data systems; we provide support, security advice, creative work and training.
This website exists to describe those services, publish our work and thinking, accept enquiries, sell digital products, and let our team manage the content. It is not a marketplace, a hosting control panel, or a substitute for a signed agreement.
03Use of the website
You may browse, read, print and share pages for your own information, and quote a short extract with attribution and a link back. Everything else is off-limits.
What you agree not to do
- Copy, mirror, scrape or harvest the site, its content or its email addresses in bulk, or feed our pages into a model or dataset without written permission.
- Interfere with the site: load it aggressively, probe it for weaknesses without our instruction, spam its forms, or submit automated enquiries at volume.
- Upload a file through any form or the dashboard that is malicious, oversized, illegal, or not the kind of media the field asks for.
- Attempt to reach another person’s dashboard account, a locked download, an admin area, or data you are not authorised to see — including by guessing order references.
- Misrepresent your identity, or use the Contact form, the comment form or the Mr Lao assistant to send unlawful, defamatory, discriminatory or harmful material.
- Post on someone else’s behalf, publish another person’s contact details without their agreement, or run a script that fills the discussion forms instead of a person.
- Remove, obscure or overrule our branding, or present KendTech work as your own.
Suspected abuse of this kind is what our logs exist for. We may block an address, disable an account and, where an offence is involved, report it to the relevant PNG authority.
04Availability of the website
We aim to keep the site up around the clock, and we build it to be dependable — but it is a website, not a utility. Planned maintenance is usually done outside PNG business hours. We do not promise that a page, a price or a product will be available at any particular moment, or that the site will be error-free.
If a fault on our side stops you completing something you were entitled to do — a download, a receipt, an enquiry — email info@kendtech.com with your order reference and we will put it right manually and tell you what went wrong.
05Dashboard accounts and staff access
The area at /admin is for authorised KendTech personnel. Administrator accounts are created by an Administrator; access follows a role — Administrator, Content Editor or Viewer — and roles are the least privilege we can give you to do your job.
- Your sign-in is personal. Do not share credentials, write passwords into project files, or leave a signed-in dashboard open on a shared machine.
- Passwords are stored as one-way scrypt hashes and are never shown to anyone, including an Administrator.
- You are responsible for activity under your account. Tell us the same day if you think it has been used without your permission.
- Money records — sales, receipts, refunds and totals — are visible only to Administrators. Confirming a payment or issuing a refund is an Administrator action and is logged.
- When you leave the team, an Administrator disables the account; disabling keeps the audit trail and removes the access.
Client portals do not exist yet. If a project of ours needs one, it will be covered by its own agreement rather than by this clause.
06Enquiries, quotations and project work
Website material — service pages, indicative pricing, a chat reply, an article — is information, not an offer. A binding proposal exists only when we issue a numbered written quotation and you accept it, and the work then runs on the terms in that quotation and engagement agreement.
Quotations state scope, price in PNG Kina, timing, assumptions, payment milestones, what happens on variation, and who owns the deliverables. Typical practice on our engagements: the client owns the finished deliverable once paid in full; we keep our pre-existing tools, libraries and general know-how; third-party licences pass through on their own terms.
You agree to give us the access, content and decisions we need when we ask. Work stalled by a missing reply is re-opened from the date we hear from you, and long stalls may need a fresh quotation.
07The Digital Marketplace: shelves, products and pricing
The Digital Marketplace sells ready-made digital items — documents and templates, business plans and proposals, software and applications, website templates, and e-books and learning material. Each product page states what you get, the format, and the price. Prices are shown in PNG Kina (K); where a product carries an international price it is shown in the currency stated at checkout. Any applicable tax is reflected in the amount presented before you pay.
We can change a price at any time before you pay. The price that binds us is the one shown for your order at the moment we take it, recorded against your order reference.
Files are delivered as downloads — there is no shipping, and no physical item is sold on this site.
08Licence to use a digital product
When you buy a product you receive a perpetual, non-exclusive, non-transferable licence to use it for your own business or studies.
- You may: use it in your own work, adapt or fill it in, print copies for your own use, and keep backups.
- You may not: resell it, give it away, upload it to a file-sharing or template site, bundle it into another product for sale, or claim authorship of the original material.
- Teams: one purchase covers your organisation’s use. If more than a handful of separate businesses need it, email us — we will price an extended licence, which is usually cheaper than everyone buying separately.
09Ordering and payment
You order by choosing an item, giving your name and email, and selecting a payment method. Your order is held against a generated reference (for example KT-6f2a9c13) that identifies it on every page, receipt and email.
Payment runs either as a deposit into our PNG bank account — you quote the reference, we confirm the money in our account — or on a payment provider’s own secure page for cards and wallets. We release a file only when the money is confirmed, never on an unverified claim to have paid.
The email address you give at checkout is where your receipt goes. Keep the order email: it is how we find your purchase if you ask for the file again.
10Refunds, disputes and chargebacks
Digital files are supplied instantly and permanently, so a change of mind is not a reason for a refund. What we do refund, when you tell us within 7 days of the order:
- the file is defective, corrupt, or materially different from what the product page described;
- you were charged twice, or charged the wrong amount;
- you bought the same item twice by mistake and have not used the second download;
- the item did not download and we cannot get it to work for you.
Ask by email with your order reference and what is wrong. Where a refund is right, we pay it back through the method you used and mark your order refunded, which locks the download again.
A chargeback or dispute raised with your bank is a different road: it stops our ability to release files for that order while it is being investigated, and we will supply our records — the order, the confirmation from your provider, the download log — to whoever is deciding it. Talking to us first is nearly always faster for you.
Free items are supplied as they are. If a worksheet or sample is not useful, tell us and we will improve it; there is no money to return.
11Receipts and record-keeping
Every paid order gets a PDF receipt showing your name, email, the item, the amount, the reference and the date. It is generated on our server and emailed when email delivery is configured, and you can request a copy later.
We keep order and payment records as long as our accounting and tax obligations require. If you need a receipt for a specific client or an audit, ask — we will reissue it.
12Intellectual property and our branding
The text, layout, design system, source code, logo, “K” mark, product files and the compilation of this site belong to KendTech SOLUTIONS or to the party who licensed it to us, and are protected under PNG copyright law and internationally. Trademarks of third parties appear only to describe work we did or technology we use.
Case studies show real projects. Client names and logos appear with permission or where the material is already public. Where a client asked us not to name them, we describe the work generically — and you are asked to do the same about them.
Our product file names, PDF watermarks and receipts carry our mark. Removing them from a licensed file is a breach of the licence above.
13What you send us
Enquiry messages, chat questions, testimonials, project material and photographs stay yours. By sending them you give us permission to use them for the purpose you sent them for — answering you, quoting you, or publishing a testimonial you offered — and to keep them in our records.
Do not send us confidential material belonging to someone else, and do not send anything you have not cleared with your own client. If you want us to treat something as confidential before we discuss it, say so and we will sign a non-disclosure agreement.
We may publish or quote a testimonial you send us, with your name and organisation, unless you tell us not to. We will not publish an identifying photo of a client contact without asking.
The discussion on a project story, an insight or a career page. Your comment stays yours. By posting it you give us permission to publish it on that page, to keep it in our records, to move it or thread it under another comment, and to quote it back to you in an email when it is approved. You confirm that you wrote it and that you have the right to post it.
- Please do not post: unlawful or defamatory material, hate speech, harassment of a person named on the page, advertising or affiliate links, another person’s personal information (an email address, phone number or photo of someone who has not agreed), or confidential material from your own employer or client.
- A person reads comments before they go live, and we may hold, unpublish or delete anything without explaining ourselves at length. The discussion is a service to our readers, not a public forum we are obliged to host.
- We moderate what is posted, but we do not verify it. A reader’s account of a project or a role is their own opinion and is not a statement by KendTech SOLUTIONS, and it is not a warranty of anything we sell.
- If a comment is closed off, edited out of a page or hidden by a filter, tell us at info@kendtech.com and we will look again — see the Privacy Policy for how to have one removed entirely.
14Mr Lao, the AI assistant
The chat assistant is an automated service. It answers from what is published on this site and from general knowledge; it cannot see your account, our internal records or a live price list.
- Its replies are not quotations, promises, technical advice, or professional advice of any kind.
- It can be confidently wrong. Verify anything material with a human being before you act on it.
- It cannot accept instructions that change a price, release a download, or alter an account.
- Use requires the AI assistant cookie choice — see the Cookie Policy.
If the assistant is unavailable or the AI service is down, the window tells you and points you to email; nothing else on the site depends on it.
15Third-party links and services
Pages here link to clients, partners, suppliers, social profiles, fonts, maps and payment services. Those destinations have their own terms and privacy policies. We choose the ones we link to carefully, but we do not control them, we do not endorse everything they say, and we are not responsible for what happens after you click.
Some pages embed a map of our campus and load type from a font service. Both are covered by your cookie choice, and both mean a third party sees limited technical information about the visit.
16Disclaimers
This site is provided as it is. We do not warrant that it is uninterrupted, free of errors, or free of harmful components, that any content is current, or that following advice in an article will produce a particular result for your business.
Article and insight content is written for general information about technology in a PNG context. It is not tailored to your circumstances; it is not legal, tax, accounting, medical or engineering advice; and technology and prices move. Check the date on the post.
Where legislation or a professional standard requires something specific, get advice on your own case. Nothing here excludes liability that PNG law does not allow to be excluded.
17Limitation of liability
To the fullest extent the law allows, KendTech SOLUTIONS is not liable for indirect, incidental, special or consequential loss — lost profit, lost revenue, lost data, lost business opportunity, damage to reputation, or the cost of substitute services — arising from your use of, or inability to use, this website, or from a digital product bought on it.
For anything we are liable for at all, our liability is limited to the greater of the amount you paid us for the item or service concerned, and K1,000.
Two things are not capped or excluded: fraud or fraudulent misrepresentation, and any liability that cannot lawfully be limited, including under PNG consumer protection principles. If a payment method you use gives you a chargeback right, nothing here removes it.
You agree to keep KendTech harmless from claims brought by someone else arising from your use of the site, your content, or your breach of these terms.
18Suspending or ending your access
We may limit, suspend or close access to any part of the site — including a dashboard account, an order download or an IP address — if we reasonably believe these terms have been broken, an account or order is being abused, a security risk exists, a payment or dispute makes it appropriate, or we are required to by law.
Where it is our error rather than yours, tell us and we will fix it. Where we close a staff account, we hand over any content the person needs to do their job elsewhere.
19How privacy and cookies fit in
Handling personal information through this site is governed by our Privacy Policy and Cookie Policy, which form part of these terms. Choosing “essential only” in the banner is a valid choice and does not affect your rights, your prices, or our willingness to work with you — it only turns off the map panel and the assistant.
20Force majeure
Neither of us is in breach when performance is prevented by something outside reasonable control: network or power failure, civil disturbance, industrial action, fire or flood, epidemic, government or regulatory action, a hosting or payment provider outage, or a widespread platform failure. We will tell you as soon as we can, keep our side working, and resume when it is safe.
21Changes to these terms
We update these terms when the site, the store or the law changes. The version number and effective date at the top of the page are how you can tell what you are reading; significant changes are flagged on the site for at least 30 days before they take effect.
Using the site after the effective date means the current version applies. Orders and engagements already in progress stay on the version that applied when they were taken unless we both agree otherwise in writing.
22Governing law, and settling a dispute
These terms are governed by the laws of the Independent State of Papua New Guinea, and the parties submit to the courts sitting in the National Capital District, Port Moresby.
Before anyone files anything, both sides agree to try to settle it practically: raise it in writing with info@kendtech.com, then a call between the people who can decide, then — if it is still stuck and the matter is worth the cost — mediation before litigation.
Most frictions on a site like this cost a few hundred kina to resolve properly. We would rather fix a relationship than win an argument.
23General
- Severability — if one clause is held invalid, the rest of these terms carry on without it.
- No waiver — us not enforcing something once does not mean we have given it up.
- No third-party rights — these terms are between you and us, except where a licence we pass on to you says otherwise.
- Assignment — you may not hand your rights over without our written consent; we may assign this website and its records with the business.
- Entire agreement (website use) — these terms, the privacy and cookie policies, and the store product pages are the whole agreement about your use of this site, and they replace anything said on the site before them.
- Notices — notice to us goes to info@kendtech.com or by post to our campus address; notice to you goes to the email you gave us, or to the account details you last corrected.
- Language — these terms are written in English. If a translation differs, the English text governs.
24Contact
Questions about these terms, or anything in them you would like explained in plain language: info@kendtech.com, +675 7877 8574, or in person at the UPNG Main Campus, Port Moresby, on a business weekday.
We will explain it in plain language.
Terms of Use — version 1.2, effective 3 November 2026, next review 1 May 2027. Email, call or walk in and we will tell you exactly what we hold, what a clause means for you, or how to change your cookie choice.
This agreement is published by KendTech SOLUTIONS and states what this website actually does. It is provided for information and is not legal advice; for a project engagement, our signed quotation and agreement govern the work. Have a Papua New Guinea practitioner review these documents before you rely on them commercially.
